LABOR AND EMPLOYMENT LAW
Lowis & Gellen has extensive federal and
state expertise in all phases of labor and employment litigation,
arbitration, mediation and counseling. Lowis & Gellen regularly handles
Title VII, ADEA, ADA, FLSA, NLRA, ERISA and FMLA matters before the EEOC,
the Illinois Department of Human Rights, the Illinois Human Rights Commission,
the Chicago Commission on Human Relations, the U.S. and Illinois Departments of Labor,
the National Labor Relations Board, and state and federal courts throughout the country.
These include age, race, sex, pregnancy, national origin, religion and disability
discrimination claims in hiring, promotion and termination, FMLA claims, retaliatory
discharge claims, sexual harassment claims, wage and hour disputes involving overtime,
vacation pay and sales commissions, unemployment compensation claims, and ERISA claims
for benefits, delinquent contributions and breach of fiduciary duty.
Lowis & Gellen also regularly represents clients in cases involving
employee misappropriation of trade secrets, breach of fiduciary duty,
breach of restrictive covenants, unfair competition, employment related
torts such as defamation, battery and false imprisonment, wrongful discharge
claims, and employee contract claims. Lowis & Gellen has extensive TRO and
preliminary injunction experience in state and federal court, particularly
in cases involving restrictive covenants, fiduciary duties and trade secret misappropriation.
Lowis & Gellen also regularly conducts overtime audits, sexual harassment
investigations and training, and drafts employee handbooks, human resource
policies and procedures, employment contracts and confidentiality/non-disclosure
agreements for its various clients.
In the collective bargaining context, the Firm has handled prevailing wage,
seniority, discipline, just cause discharge and bumping claims in arbitration,
and has over thirty years of experience negotiating collective bargaining agreements
with a variety of unions, including the Teamsters, Food Workers, Laborers, Operating
Engineers, Carpenters, Masons, Electricians, Ironworkers, Boilermakers, Printers and Pressmen.
